Effective March 27, 2023, in-person appearance will be required on discovery motions,
only, filed before Justice Anna Culley [Part 27], Justice Phillip Hom [Part 14], Justice Denise N.Johnson [Part 11], Justice Mojgan C. Lancman [Part 20], Justice Leonard Livote [Part 33], and
Justice Frederick D. R. Sampson [Part 31]. Please note that discovery motions filed before
Justice Phillip Hom and Justice Denise N. Johnson will require an appearance at the Long Island
City courthouse located at 25-10 Court Square, Long Island City, New York.
Effective April 17, 2023, in-person appearances will be required on discovery motions,
only, filed before Justice Carmen R. Velasquez [Part 38].
Discovery motions include motions made pursuant to Article 31 of the CPLR, 22 NYCRR
§202.7 and 22 NYCRR §202.8. Motions for summary judgment are not included in this
category.
A copy of the NYSCEF Confirmation Notice(s) for any document(s) e-filed by a party under
the sequence number of the discovery motion must be submitted by that party to the Part Clerk on the return date, or any adjourn date, of the discovery motion.
The Part rules for the above Justices should be reviewed prior to filing a discovery related
motion.

SUPREME KINGS INSTRUCTIONS FOR DISCOVERY PARTS UNTIL FURTHER NOTICE:
The Kings County Administrative Judge is presently presiding over all of the Kings County Discovery Parts. All inquiries (including calendar, clerk marking inquires, processing of orders) must be directed to the respective part clerk.

Until further notice, there are no physical appearances in the Kings County Discovery Parts.
Preliminary conference orders are being generated and issued by the Court. The signed and entered orders will be uploaded to e-file/county clerk minutes.
CCP OSC/motions, not otherwise previously resolved on consent, shall be decided, on submission (no oral arguments), by the Administrative Judge on the scheduled return date.
STRONGLY RECOMMENDED: E-file proposed CCP OSC/motions orders resolved on consent (or withdrawals) at least two days prior to your scheduled return date to avoid your CCP motion/OSC being submitted. City/TA motions shall not be on submission.
All correctly submitted (E-file) consent orders shall be reviewed, signed, and processed ASAP. Parties may also submit (E-file) consent orders to amend prior discovery orders (if NOI or discovery dates have passed); vacate or extend NOI; or restore. Use applicable court form and detail and include all outstanding discovery with proposed on or before certain dates.
All parties that cannot submit a proposed order on consent, shall submit (E-file) a request for virtual conference form (for FCP/FDP and CDP scheduled appearances only) and wait to be notified.
This court shall send notices, alerts, and schedule some virtual appearances via E-file and regular clerk systems. Please ensure that your appearance alert system (elaw, ecourts, etc.) is working properly and is current and correct and that all of your E-file contact information (including email) is current and correct.
The New York State Unified Court System has adopted Microsoft Teams as the standard for internal and external videoconferencing calls, including virtual court hearings.

As part of our effort to provide court staff and the public with up-to-date accurate information about the impact of the coronavirus upon the courts – and especially as COVID-19 testing becomes more broadly available — we ask the following:If you test positive for COVID-19 and have visited any UCS courthouse or court facility in the prior fourteen days, please notify the court system immediately at 833-503-0447.
We will then notify court personnel, attorneys and other members of the public who may have been at risk of exposure, in order that they may contact their medical professionals and take appropriate further steps for their and their families’ health and safety. Thank you for your cooperation in this important notification effort during these challenging times.
During the current coronavirus public health emergency, the NY State Court System remains open to address all essential and critical needs of the public. Concurrently, we continue to work closely with our partners in government, including State and local health authorities, to take appropriate measures in order to prioritize the health and safety of all court visitors and staff.

However, in an effort to continue court operations efficiently and minimize future calendars, please advise the Court of any cases that have settled. In the upcoming days and weeks, Judge Evans and Judge Katsanos will begin reaching out to the parties on No Fault cases to schedule telephone or Skype conferences. We will begin with the calendars from today through April 1, and then if the situation continues, contact parties on future calendars.

First and Second Departments of the Appellate Division As part of the response plan to COVID-19, the First and Second Departments of the Appellate Division have decided that all matters on the Courts’ calendars will be taken on submission. This effort will reduce courthouse traffic and is consistent with New York State’s recommendation to limit public gatherings. The change will go into effect on March 17, 2020 and will continue until further notice.However, each of the departments are making arrangements for those litigants who still wish to argue their appeals. Argument will not be permitted in person but, upon request, appearance can be made via Skype. Bronx County Bar Association Notice to All Attorneys Having Cases Assigned to the LPM (Labor Law, Products Liability, Malpractice (Other than Medical)) Part Effective immediately and until further notice: 1. All Preliminary, Compliance, Status and Pre-Trial conferences scheduled on March 24, 2020, and thereafter will be adjourned to a future date. Attorneys of record will be notified of the adjourn date(s). However, attorneys should check E-Courts for adjourn dates. 2. In lieu of appearances on Preliminary, Compliance and Status Conferences attorneys may submit an order on consent of ALL parties to jflores2@nycourts.gov • This option is only available for cases where 7 or less prior compliance/status conferences were held. • If all parties sign the form and return it to the court before a scheduled conference date, such form will be “so ordered” by the court, the conference will be marked held and a future date will be scheduled for a compliance or further status date. • Signed Orders will uploaded to NYSCEF (for e-filed cases) or Bronx County Clerk’s Office (for non-e-filed cases). • Any unresolved issues will require an appearance. • When emailing Orders/Stipulations to the court include all parties. 3. Orange County Foreclosure Settlement Part Due to mounting concerns regarding the Coronavirus pandemic, foreclosure settlement conferences scheduled before me are being adjourned 45 days. Southern District Update Effective Monday, March 16, 2020, the following protocols will be in place for the next 30 days, or until further notice:1.No new jury trials, civil or criminal, will be permitted to commence in any of our three courthouses (Moynihan, Marshall, Brieant).2.Jury trials that have already commenced will be concluded. Judges conducting those trials – there are five of you – have been provided with special information about meals and transportation to share with your jurors.3.The running of speedy trial time will be suspended effective today due to the now-declared state of emergency and medical crisis.4.Existing grand juries will continue to meet. We will consult with the USAO before deciding whether to try to empanel the April 2 grand jury.5.Until further notice, Magistrate’s Court will be conducted in its usual location on the Fifth Floor of the Moynihan Courthouse. If there are presentments in White Plains, they will be handled by the Duty Magistrate in White Plains.6.Until further notice, Part I will be staffed out of the Foley Square courthouses. FYI: next week’s duty judges are Swain (Monday, March 16); McMahon (Tuesday, March 17-Saturday, March 21).7.The courthouses will not be closed. However, only the following persons will be admitted: judges, chambers staff, SDNY supervisory personnel (unit executives and managers), SDNY personnel who are on “skeleton” duty (see below), lawyers who have to appear in district court civil matters or before the Court of Appeals, Assistant United States Attorneys, defense lawyers, criminal defendants and members of their families, persons who have been directed to report to Probation and PreTrial Services, visitors to the Pro Se Clinic in the Marshall Courthouse, and credentialed courthouse press. No one who does not have case-related business in the courthouse will be permitted to enter. Even persons who are otherwise authorized to enter must pass the screening protocol, which can be found in the Second Amended Standing Order in the matter now entitled In re Coronavirus/COVID-19 Pandemic (M-10-468), entered today. |
